1. This agreement

These terms are a contract between you and TODO — registered legal name (TODO — trade register no.), TODO — registered address, Romania, Romania — "we" or "us" below. They cover the Hairstyle Swap mobile app and this website.

By creating an account or using the app you accept them. If you do not, please do not use the service. Our Privacy Policy forms part of this agreement.

2. Who may use it

You must be at least 16 years old. By using Hairstyle Swap you confirm that you are, and that nothing in the law of your country prevents you from entering this agreement.

3. Your account

Accounts are created with Google Sign-In; there is no separate registration and no password for us to lose. Signing in with a Google account we have not seen before creates an account automatically.

Keep control of the Google account you sign in with — anyone who has it has your tokens. Tell us at [email protected] if you think someone else is using your account. One account per person; accounts are not transferable.

4. Tokens

• One token buys one generation, which returns your try-on. At current rates that is about $1 a look.
• Tokens never expire. There is no monthly fee, no subscription, and no balance that quietly drains while you are away.
• Tokens are not money. They have no cash value, earn no interest, are not a payment instrument or electronic money, and cannot be sold, transferred, gifted or exchanged for cash.
• Your balance is held on our servers and is the authoritative one. A modified or offline copy of the app cannot create tokens.
• A failed generation costs nothing. If the model does not return a result, the token is automatically returned to your balance. If you are ever charged for something you did not receive, tell us and we will fix it.
• Deleting your account forfeits any unspent tokens. The deletion is irreversible and the balance cannot be restored afterwards.

5. Buying tokens, and getting your money back

Token packs are sold through the Apple App Store and Google Play. They are the seller of record: they take the payment, they hold your payment details, and their own terms govern the transaction. Prices shown in the app include any tax they collect on our behalf. We are told only that a purchase was validated, and credit your balance on that basis.

Refunds. Because Apple and Google are the sellers, refund requests normally go to them, under their published policies.

If you are a consumer in the EU or the UK, you also have a statutory right to withdraw from a purchase of digital content within 14 days, and nothing here removes it. It works like this:

• Tokens you have not spent can be withdrawn from within 14 days of purchase, for a refund of that portion.
• Tokens you have already spent cannot. By spending a token you ask us to perform the service immediately and acknowledge that, once a generation has been delivered, the withdrawal right for that token is lost — this is the express consent the Consumer Rights Directive requires.

To withdraw, email [email protected] within the window. You do not have to give a reason.

We may change prices at any time, but never for tokens you have already bought.

6. Your photos

Your photos stay yours. We claim no ownership of anything you upload, and no ownership of the images the app generates for you — those are yours to keep, post and show your stylist.

You grant us a narrow, temporary, worldwide licence to process your photos for the sole purpose of producing the try-on you requested, and to pass them to the AI provider that performs it. That licence ends when the generation does. It does not let us publish, share, license or train models on your images, and we do not.

You confirm that, for every photo you upload:

• you own it, or otherwise have the right to use it;
• if it shows another identifiable person, they have agreed to you using their photo this way;
• it does not infringe anyone's rights.

7. What you must not do

Do not use Hairstyle Swap to:

• upload photographs of anyone under 16, in any context;
• upload a photograph of someone who has not agreed to it — including public figures — or create an image intended to deceive people about who someone is or what they did;
• produce sexual, hateful, harassing, violent or otherwise unlawful imagery;
• impersonate anyone, or misrepresent a generated image as a photograph;
• break, probe or overload the service, bypass the token system, or access the API by automated means or outside the app;
• reverse-engineer, decompile or resell any part of the service, except to the extent the law says you may.

Breaking these rules can cost you your account. Where a breach is serious — unlawful imagery above all — we may suspend or terminate immediately and without notice, and unspent tokens are forfeited.

8. What an AI preview is, and is not

This matters more than anything else on this page, so it is not buried in the disclaimers.

• Results are generated illustrations. They are not photographs, not predictions, and not a professional opinion.
• Whether a cut or colour will actually work on your hair depends on texture, density, growth pattern, condition and previous chemical treatment — things a model looking at one photo cannot know. Your stylist confirms what is feasible. Please do not book, cut or dye on the strength of a preview alone.
• Output varies. The same inputs can produce different results, different users can receive similar ones, and a result may not resemble you closely. That is how these models behave, and it is not a defect.
• You are responsible for what you do with an image you generate — in particular, for anything you publish.

9. Availability and changes

We work to keep the service running but do not promise it will be uninterrupted or error-free. It depends on third parties — Google, the AI provider, the app stores — and on your device and connection.

We may change, suspend or discontinue features. If we discontinue the service altogether, we will give reasonable notice in the app and offer a refund of unspent token balances to anyone who asks within the notice period.

You may stop at any time by deleting your account in the app. Section 4 explains what happens to unspent tokens.

10. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow to be limited. Your statutory rights as a consumer are unaffected, and where these terms conflict with a mandatory consumer protection in your country, that protection wins.

Subject to that: the service is provided as it is; we are not liable for indirect or consequential loss, or for a hairstyle decision made on the strength of a preview; and our total liability to you for any claim is limited to the amount you paid us in the twelve months before it arose.

11. Governing law and disputes

These terms are governed by Romanian law, and the courts of Romania have jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings in your own local courts. The European Commission also provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

Please write to us first. Most things are a misunderstanding and an email fixes them.

12. Changes to these terms

We may update these terms. For material changes we will give notice in the app before they take effect, and the effective date at the top of this page will move. Continuing to use Hairstyle Swap after that means you accept the new version; if you do not, you may delete your account, and if you do so within 30 days of a material change we will refund any unspent token balance on request.

13. General

If a provision turns out to be unenforceable, the rest stays in force. Our not enforcing something immediately does not waive it. You may not transfer your rights under this agreement; we may transfer ours if the business is sold, and your rights will not be reduced by that.
